Terms and Conditions

By completing your booking and payment at checkout, you agree to these Terms and Conditions. Please read them carefully to ensure your waste is managed safely, efficiently, and in compliance with New Zealand regulations.

1. Payment Terms

  • Residential Customers: Full payment is required before bin delivery unless cash on delivery is arranged at booking. Payments via checkout must use accurate payment information.
  • Commercial Customers: Payment is due within 7 days of invoice issuance unless otherwise agreed in writing.
  • Payment Methods: We accept Visa, MasterCard, and bank transfer and cash. Extra charges (e.g., overweight bins, extra days, non-collection fees) may be charged to the payment method provided post-collection, with prior notification.
  • Overdue Accounts: Overdue invoices incur interest at 10% per annum, calculated daily. If referred to debt collection, you will be liable for all reasonable fees, commissions, and legal expenses, added to the outstanding balance.

2. Hire Period

  • Standard Bin Hire: The hire period is agreed at booking. No deliveries or collections occur on public holidays or Sundays unless arranged.
  • Residential Hire: Additional bin hire is charged on a daily basis, subject to bin availability. The daily charge will be stated on the product page of the website, and the customer agrees to this charge. Extensions must be requested and confirmed before the hire period ends.
  • Commercial Hire: As arranged at booking or per written agreement.
  • Early Collection: No refunds for early collection unless agreed under the Refund Policy.

3. Prohibited Waste Materials

If you have any of the following prohibited materials, please contact us to arrange special disposal. Do NOT place it in your skip bin. 

  • Gas bottles, asbestos, chemicals, vehicle batteries, wet paint and any toxic, hazardous, or biological waste.

Costs arising from prohibited materials will be charged to you.

4. General Rules for Bin Use

  • Load Limits: Per New Zealand Transport Agency (NZTA) regulations, bins must not be loaded past the top edge. Overfilled bins may incur fees or be refused collection.
  • Bagging Requirements: Dusty products, nappies, and food waste must be securely bagged.
  • Bin Placement: Do not move the bin from its delivery location. Costs for bin damage or inaccessibility will be charged to you.
  • Public Land: Bins on public land (e.g., roadside, footpaths) may require a council permit. Contact your local council for details.
  • Access: Ensure clear access (e.g., open gates, restrained pets, no vehicles) with a minimum 3m width for truck access on delivery and collection days.
  • Fire Safety: Do not light fires in the bin or place flammable materials.
  • Site Safety: Notify us of site-specific hazards (e.g., uneven ground, overhead wires, underground services) at booking.
  • Your Responsibility: You are liable for bin misuse, including repair costs for damage caused by overloading or unauthorized movement.

5. Loading Guidelines for Recycling

We prioritise recycling, processing waste at our Hamilton facility to minimise landfill use. Load bins as follows:

  • General Waste Bins: Putrescible and dusty materials must be bagged. Excess soil, or concrete may exceed weight limits and incur extra charges. Prohibited waste materials are not allowed (see section 3).
  • Hardfill Bins (3m³ only): Only bricks, tiles, soil, or concrete. No green waste or general waste.
  • Greenwaste Bins: Only garden waste. General rubbish or topsoil incurs general waste rates. No flax, palm, or tree stumps.

6. Bin Sizes and Weight Limits

General and green waste bins have weight limits. Overweight bins are charged at $0.20/kg  above the limit, measured at a weighbridge post-collection:

  • 3m³: 500kg
  • 4.5m³: 750kg
  • 6m³: 1000kg
  • 9m³: 1500kg

Hardfill bins (3m³ only) have no weight limit, but must not be overfilled. Charges are applied to the payment method provided, with notification.

7. Refund and Cancellation Policy

  • Consumer Rights: Nothing in these terms limits your rights under the Consumer Guarantees Act 1993. If we fail to deliver the bin as agreed (e.g., non-delivery, incorrect bin, or faulty bin), you may be entitled to a remedy (e.g., replacement, repair, or refund).
  • Other Refunds: Refunds for other reasons are assessed case-by-case. Requests must be made within 7 days of delivery and are processed within 14 days. No refunds for customer errors (e.g., overfilling, wrong bin).
  • Cancellations: Cancellations less than 24h prior to booking will incur a $50 admin fee.

8. Property Access and Liability

  • Access Instructions: You must provide clear delivery instructions (written or verbal) specifying access routes and bin placement. If no instructions are not provided or suitable, we’ll place the bin in a safe, suitable location chosen by the driver during delivery. Relocating the bin after delivery, if no instructions were given, will incur an extra fee.
  • Risk Acknowledgement: By directing heavy vehicles and bins onto private property, you accept inherent risks of non-negligent damage, such as tire marks, surface cracks, scratches & stains, damage to branches/trees, low hanging wires or underground services.
  • Damage to property: Any damage caused to property by Purpose Fill Ltd will be investigated and assessed on a case-by-case basis. Purpose Fill Limited is insured for public liability up to $2,000,000. We will not claim liability for non-negligent damage when drivers follow explicit instructions and exercise reasonable care while carrying out our service. 
  • Your Responsibilities: Notify us of property conditions (e.g., weak pavement, soft ground, underground services, low-hanging wires, tree branches) at time of booking. Report damage within 48 hours post-service. Submit claims in writing within 7 days, with photos and details, to [email protected].
  • Dispute Resolution: Damage disputes will be resolved through negotiation or mediation to avoid litigation.

9. General Liability

  • You are responsible for bin misuse and resulting damage to the bin or third-party property.
  • We take reasonable care during delivery and collection but are not liable for property damage unless caused by our negligence.
  • You agree to indemnify us against claims or costs from your breach of these terms, except where we are at fault.
  • We are not liable for delays or damage due to events beyond our control (e.g., weather, strikes), but will notify you promptly.

10. Booking and Checkout

  • You confirm that all booking information (e.g., delivery address, waste type, hire period) is accurate. We may refuse or cancel bookings if information is incomplete or inaccurate.
  • Prices at checkout include GST and are based on the selected bin size, hire period, and waste type. Additional charges apply for overweight bins, extended hire, or non-compliance.
  • Delivery occurs within 6am-6pm on the agreed date, subject to availability. Same-day delivery may be available—contact us.
  • We reserve the right to refuse service if unsafe or unfeasible.

11. Privacy

  • Personal information provided at checkout is handled per our Privacy Policy, available on our website, and shared only for service delivery or legal compliance, per the Privacy Act 2020.

12. Governing Law

These Terms and Conditions are governed by New Zealand law. Disputes are subject to the exclusive jurisdiction of New Zealand courts.
